LC2S212 and LC3S321 Assessment Description

Nolly viewed and later purchased the fee simple of a large period property in Bath.

Whilst viewing the property she noticed some items that she thought to be of value and assumed that they would be included in the sale.

These items were:

  1. A large picture of the seller’s family secured to a wall in the snug with a picture hook.
  2. A large modern clock hanging from a decorative Victorian bracket attached to the wall in the gardens.
  3. A large, modem static caravan stood on stone pillars and attached to mains services but otherwise unattached to the land.
  4. A houseboat moored to the pontoon adjacent to the property by rope mooring
    lines.

When Nolly took possession of the property, she discovered that all these items had been removed by the seller, with any damage made good.

Advise Nolly of any claim she may have to these items, supporting your advice with reference to relevant legislation and case authorities. You can assume that there was no express contractual agreement as to ownership of the items.
